Regulation Exemption
Consider the following 4 questions:
- Do you produce more than 220 lbs (about 25 gallons) of hazardous waste per month?
- Do you produce more than 2 lbs of acutely hazardous waste per month or store more than 2 lbs at any time?
- Do you produce more than 220 lbs of contaminated soil, residues or debris caused by acutely hazardous waste per month or store more than 220 lbs on-site at any time?
- Do you store more than 2200 lbs of hazardous waste on-site at any time?
If you answered "yes" to any of the questions:
It appears that you are NOT exempt from hazardous waste regulations because you exceed minimal production or storage limits. You must meet guidelines established by the EPA and the Idaho DEQ for hazardous waste generators.
To determine your hazardous waste generator class, along with proper disposal methods, contact the Idaho Department of Environmental Quality (DEQ).
If you answered "no" to all of the questions:
You may qualify as a conditionally exempt small quantity generator of hazardous waste. For verification of this status and information about proper disposal of hazardous wastes, contact the Idaho DEQ.
